Ebonyi Court Stop PDP Caretaker Committee



High Court in Ebonyi State have on Thursday stop the members of the newly sworn in Ebonyi state Caretaker Committee of the People Democratic Party (PDP) from assuming such offices.

This stop is in line with an ex-party motion brought forward by the Nwebonyi Onyekachi led State Working Committee of the Party which was earlier dissolved by the National Executive Committee of the party.

Mr. Nwebonyi, ( the Chairman) and Members of the State Working Committee of the party were dissolved last week following the defection of the governor, Umahi David to the All Progressive Congress (APC).

The National Working Committee (NWC) of the party also announced and inaugurated a nine member caretaker committee headed by Udogu Fred.

But Nwebonyi and other members of the State Working Committe sued the People’s Democratic Party (1st respondent) the National Chairman, Uche Seconds (2nd respondent) challenging the dissolution.

Also joined in the suit as 3rd to 11th respondent are the nine members of the Caretaker Committee.

The plaintiffs represented by their Counsel, Umahi Roy, alleged wrongful dissolution of the State Working Committe claiming that they were not given fair hearing before the purported dissolution.

In a motion ex parte, the State Working Committee members prayed the court to grant an order of interim injunction restraining the PDP from dissolving the SWC and from continuance of the purported dissolution or giving effect to the purported dissolution of the State Working Committed of the PDP at state, local government or ward level.

The plaintiffs also sought an interim injunction restraining the first respondent (PDP) and second respondent (Secondus) from continuance of the purported establishment or composition or recognition of the Caretaker Committee comprising the 3rd to 11th respondents

The plaintiffs further prayed the court to restrain the PDP and Seconds from inaugurating, transferring to, and /or vesting on the 3rd to 11th respondents the authorities, powers and/or functions of the exercised members of the State Executive of the party at state, LGA and ward levels pending the determination of the motion on notice.

They also urged the court to restrain the 3rd to 11th respondents from parading themselves as caretaker committee members in charge of Ebonyi State chapter of the party and or usurping the powers and function of the State Executive Committees at the state, LGA and ward levels pending the determination of the motion on notice.

The plaintiffs further prayed the court to grant them leave of substituted service to the respondents.

The plaintiff’s lawyer, Mr. Roy Umahi further argued that there were no facts warranting or necessitating the dissolution by the 1st and 2nd defendants of the of Ebonyi State Executive Council Committee of the PDP at the State, local government and ward levels each selected for a four year tenure.

He further noted that there was no genuine reason for the setting up of a caretaker committee.

Mr. Roy further argued that neither the National Executive Committee nor any other organ of the party has the power or authority to dissolve the local government and ward executives of the party before the expiration of their tenures.

In his ruling, the presiding Judge, Justice Elvis Ngele granted all the prayers of the plaintiffs.

He, thereafter, adjourned the matter to December 2, 2020 for hearing.

Reacting, Mr. Nwebonyi said the ruling is a landmark which will in turn end an era of impunity in the party.

He further noted that with ruling the State Working Committee led by him, will continue to carry out its activities uninterrupted.

PDP Convention: Governor Fintiri Inspects Venue

PDP national convention, governor Fintiri Inspects facilities and venue at the Eagles square.

Ahead of the Saturday October 30th National Convention of the People’s Democratic Party (PDP), the Organizing Committee Chairman Adamawa State Governor Ahmadu Umaru Fintiri and his Deputy Governor Douye Diri of Bayelsa State have been inspecting facilities at the Eagle Square venue on Tuesday.

The Committee Chairman was at the Square to see things for himself and assess the readiness of the sub committees towards the conduct of the convention.
At hand to receive and brief the Chairman and his Deputy were sub committee Chairmen of electoral, venue, security, protocol, accreditation and transport.

Governor Fintiri commended the sub committees for working hard to ensure the success of the exercise.
“You have worked hard and I must commend your zeal and determination to reposition the party and give her a fresh breath”. Governor Fintiri said.

After conducting the Organising Committee Chairman round, they promised not to let him down, describing his passion to deliver a credible and successful Convention as encouraging to both committees and members of the PDP family.

They could not hide their satisfaction with the way and manner the Chairman and his team have been spearheading the process.
They noted that Governor Fintiri has proven that there is still hope for Nigeria by his strategic leadership in steering a more organised Convention.

From the convention ground, the Organising Committee Chairman led other members to condole with the family of Senator Phillip Aduda the venue sub committee Chairman over the loss of his father the Rt Reverend Taminus Aduda Bishop Emeritus of the Anglican Diocese of Gwagwalada.

The 76th year old Aduda Patriach died on 20th October 2021 after a brief illness.
While commiserating with Senator Aduda and the family, Governor Fintiri who described the deceased as a proud father who raised great children that have contributed to the growth and development of the nation, urged the family to take solace in God and bear the irreparable loss.

He said the late Bishop will be sorely missed especially when his wise counsel is most needed.

Political Campaign Turns Bloody as Gunmen Launch Attack in Anambra State



Gunmen attacking

Political campaign have turn to bloody one at Anambra State, Nigeria as Gunmen launch attack on political members.

Gunmen launched an attack on members of the All Progressives Grand Alliance (APGA) and All Progressive Congress (APC) during the political parties’ rallies at different locations of Anambra State.

According to eyewitness, the gunmen also left several other persons injured and set ablaze a car belonging to a leader of Professor Chukwuma Soludo group.
Soludo is a former governor of the Central Bank of Nigeria (CBN).

While the attack on the APC members took place during the party’s rally at Uruagu, Nnewi, the attack on the leader of one of Soludo Support Groups, Nnelsonn Omenugha took place at Nnobi in the Idemili South local government area of the state.

Report have it that one APC member, whose identity could not be immediately ascertained was killed in the attack with scores wounded, while the attack on the APGA chieftain took place in his hometown, Nnobi.

Although the police have yet to react to the two incidents, the state publicity secretary, of APC, Okelo Madukaife confirmed the attack.He was quoted as saying: “The attack led to the cold death of our committed party official and the hospitalisation of many others.

“Our party regrets the invasion of our office and attack of members who were gathered for a meeting in Uruagu Ward 3, Nnewi by persons yet to be identified. “We regret the loss and regard it as one violence too many in an Anambra State that ought to be the safest state in Nigeria if official claims were anything to go by.

“We speak for the mood in our dear state where similar attacks took place at Afor Nnobi Junction, on the same day killing men of the Vigilante in Alor, Idemili South in transit and call for a total halt.

“Our party commiserates with the family of the deceased who will be identified in the near future and assure that their loss is our loss and Anambra State’s loss, but that their son shall not die in vain.

“We acknowledge security in Anambra State as an area that requires serious intervention.”

On the attack on Omenugha, who is a staunch campaigner of ‘Soludo for Governor’, it was gathered that the attackers set his car ablaze, while he escaped to safety.

Edo High Court Nullifies Removal of Etsako West LGA




Edo State high court nullifies the unlawful removal of elected ETSAKO WEST L.G.A council chairman hon. Yakubu O. Musa:

The purported suspension and removal of Hon. Yakubu O. Musa of APC has been declared invalid,null and void and unconstitutional by Edo State High Court No 12, Benin City Presided over by Hon . Justice V.O Oviawe in suit no B/204/2019.

In the judgment delivered on the 27th day of September, 2021, the learned trial judge declared the purported removal of Hon. Yakubu O. Musa by Edo State Governor as null and void.

Hon. Justice V.O Oviawe granted all the prayers contained in the originating Summons except prayer i which is already overtaken by event because the tenure of the office had lapsed, The suit was filed on behalf of Hon. Yakubu O.Musa by the Law firm of West-Idahosa & Co.

The learned Judge held that Edo State Governor and the Government failed to comply with the Provisions of Sections 20 and 21 of Edo State Local Government Law, 2000 (as amended) in failing to consult with the Edo State House of Assembly and the grounds of suspension as provided by Law before suspending Hon. Yakubu O. Musa was did not follow the extant law.

The Court further held that since the purported suspension was void in law, every other action predicated on it was invalid. And held that the 1st-4th defendants lack the power to suspend and remove the Claimant on ground of fraud without given him fair hearing

The Court awarded the sum of #100,000 as costs in favour of the Claimant.

The case was conducted on behalf of the Claimant by Famous Osawaru Eremwanarue Esq., of West Idahosa Law Firm.
